ACO Terms and Conditions

1. Acceptance of Terms
By requesting, submitting, or using the Automated Checkout Service (“ACO”, “Service”, “we”, “us”, or “our”), you agree to be bound by these Terms and Conditions (“Terms”).
If you do not agree to these Terms, do not submit an ACO request. Submission of an ACO request and continued use of the Service constitutes your explicit agreement to all provisions contained herein.
2. Definitions
For the purposes of these Terms, the following definitions apply:
ACO / Automated Checkout Service The non-tangible, electronically provided service that attempts to place online retail orders on a user’s behalf using automated methods.
Service Refers collectively to the ACO, all related tools, workflows, communications, and operational processes.
User / You / Your Any individual or entity requesting, submitting, or using the Service.
Checkout Success / Successful Checkout A completed checkout event where an order is successfully placed and confirmed by the retailer, regardless of later fulfillment, shipment, or cancellation.
PAS (Pay After Success) A pricing model where service fees are charged only after a Successful Checkout occurs.
PAS Fee The service fee owed for a Successful Checkout, exclusive of item price, taxes, shipping, or retailer-imposed fees.
Invoice Reminder A notice sent to the User requesting payment of an outstanding PAS Fee following a Successful Checkout.
Payment Method on File Any payment method submitted by the User, whether for checkout purposes or fee collection, including but not limited to cards, digital wallets, or payment apps.
Retailer Any third-party store, platform, or merchant where checkout attempts are performed.
Random Sizing A request option where any available size may be purchased if a preferred size is unavailable.
3. Service Description
The ACO Service is a non-tangible, electronically provided service that attempts to place online retail orders on your behalf using automated methods.
You acknowledge and agree that:
Successful checkout is not guaranteed
Order fulfillment is entirely controlled by the retailer
Retailers may cancel, modify, or refuse orders at their discretion
The Service only attempts checkout using the information you provide
4. Eligibility and Authority
By using the Service, you represent and warrant that:
You are legally capable of entering into binding agreements
You have full authorization to use any payment method provided
You will comply with all applicable laws, retailer policies, and platform rules
5. User Responsibilities
You are solely responsible for:
Providing accurate, complete, and up-to-date information
Ensuring your payment method is valid, funded, and authorized
Reviewing all order details prior to submission (item, size, quantity, address, contact info)
Monitoring your email and payment method for order updates
Requests containing incomplete or inaccurate information may be ignored or fail without notice.
6. Payment Terms (Pay After Success)
The Service operates under a Pay After Success (PAS) model.
You are only charged if a checkout is successfully completed. If checkout fails, no service fee is charged.
6.1 Accepted Payment Methods
Payments may be collected via:
Zelle
PayPal
Cash App
Venmo
Stripe
6.2 Payment Method Authorization
By submitting payment information, you expressly authorize the following:
Dual-Purpose Authorization Payment methods may be used both to complete retail purchases and to collect PAS fees.
PAS Fee Collection Any payment method on file may be charged for PAS fees once checkout is successful.
Unpaid Invoice Collection If an invoice remains unpaid for 48 hours after an Invoice Reminder is sent, you authorize us to charge any payment method on file without further notice.
Multiple Payment Methods If multiple payment methods are provided, any or all may be used to satisfy outstanding balances.
Continued Authorization Authorization remains active until all balances are paid in full and removal of payment information is formally requested, subject to pending transactions.
6.3 PAS Pricing & Market Adjustments
PAS pricing is dynamic and may change at any time due to:
Market demand
Product scarcity
Retailer behavior
Checkout difficulty
Operational risk or cost
Past PAS rates do not establish precedent.
The applicable PAS fee is the rate disclosed at the time the invoice is issued or otherwise communicated for that checkout.
PAS fees are non-refundable after shipment, regardless of delivery issues, damaged items, returns, or retailer refunds.
6.4 Nonpayment & Enforcement
If payment is not received within 48 hours of the Invoice Reminder:
The outstanding balance may be charged automatically
You may be permanently banned from the Service and placed on a blacklist for other providers.
Future access may be denied without appeal
7. Fees, Taxes, and Charges
You are responsible for:
Item cost
Shipping fees
Taxes
Retailer-imposed charges
Currency conversion or bank fees
Service fees apply only after a Successful Checkout.
8. Finality of Transactions
Once checkout is successfully completed:
The transaction is considered final
Changes or cancellations are subject solely to retailer policy
The Service does not guarantee post-checkout modifications
9. Cancellations and Refunds
If a retailer cancels the order, the PAS fee is refunded
User-requested cancellations are subject to retailer policies
PAS fees are non-refundable after successful checkout
10. Unauthorized or Unwanted Charges
You are responsible for reviewing all charges.
Chargebacks or disputes initiated without first contacting support may be considered a violation of these Terms and may result in service termination or blacklisting.
11. Random Sizing Disclaimer
If random sizing is selected:
Size preference is not guaranteed
Checkout proceeds with any available size
No refunds are issued due to size dissatisfaction
12. Availability & Performance Limitations
You acknowledge that:
Inventory may change instantly
Queue systems or bot protection may block checkout
Site outages may occur
Success rates vary and are not guaranteed
13. Prohibited Use
The Service may not be used for:
Illegal or fraudulent activity
Circumventing retailer policies
Harassment, abuse, or misuse of systems
Resale or misuse that violates platform terms
14. Third-Party Platforms
The Service relies on third-party platforms.
We are not affiliated with, endorsed by, or responsible for retailers, payment providers, or fulfillment outcomes.
15. Limitation of Liability
To the maximum extent permitted by law:
The Service is provided “AS IS” and “AS AVAILABLE”
We are not liable for indirect, incidental, or consequential damages
Total liability shall not exceed the PAS fee paid for the applicable checkout
16. Indemnification
You agree to indemnify and hold harmless the Service provider from any claims, damages, losses, or expenses arising from:
Your use of the Service
Violations of these Terms
Violations of third-party policies or rights
17. Termination
We reserve the right to refuse service, suspend accounts, or permanently ban users at any time for violations, abuse, or operational risk.
18. Changes to These Terms
We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
19. Governing Law
These Terms are governed by the laws of the applicable jurisdiction of the Service operator, without regard to conflict of law principles.
20. Severability & Entire Agreement
If any provision is found unenforceable, the remaining provisions remain in full effect.
These Terms constitute the entire agreement between you and the Service regarding ACO usage.
